1. Acceptance of Terms
By accessing or using the Growwth platform and website ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms apply to all users, including administrators, managers, and employees (learners) accessing the Service.
2. Description of Service
Growwth is a cloud-based learning management platform that enables organisations to create, deliver, and track card-based training courses for their teams. The Service includes course creation tools, learner access via magic links, progress tracking, analytics, and related features.
3. Account Registration
To use Growwth as an administrator or manager, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised use of your account
You must be at least 18 years old to create an account. Accounts are for individual use only and may not be shared.
4. Plans and Payment
Free Plan
The Free plan is available at no cost and includes limited features as described on our Pricing page. We reserve the right to modify Free plan limits at any time with reasonable notice.
Pro Plan
The Pro plan is billed monthly. Payment is due at the start of each billing period. Fees are non-refundable except as required by applicable law. We use a third-party payment processor and do not store your payment card details.
Plan Changes
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of the next billing period. Cancellation stops further billing but does not entitle you to a refund for the current period.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Upload or distribute harmful, offensive, or illegal content
- Infringe the intellectual property rights of others
- Attempt to gain unauthorised access to any part of the platform
- Reverse-engineer, decompile, or disassemble the Service
- Use automated tools to scrape, crawl, or extract data without permission
- Harass, impersonate, or harm other users
- Distribute malware or other harmful code
We reserve the right to suspend or terminate accounts that violate these terms.
6. Content Ownership
Your Content
You retain full ownership of all courses, content, and data you upload or create on Growwth. By uploading content, you grant us a limited licence to host, display, and deliver that content to your designated learners as part of providing the Service.
Our Content
All platform software, design, trademarks, and original content provided by Growwth are owned by us and protected by intellectual property laws. You may not reproduce or distribute our content without written permission.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Service Availability
We aim to provide a reliable, high-availability service but do not guarantee uninterrupted access. We may perform scheduled maintenance and will endeavour to provide advance notice. We are not liable for losses arising from service downtime or interruptions.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of Liability
To the maximum extent permitted by law, Growwth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
Either party may terminate the agreement at any time. You may close your account by contacting us or through the platform settings. We may suspend or terminate your account if you breach these Terms, with or without notice depending on the severity of the breach.
Upon termination, your right to access the Service ceases. You may request an export of your data within 30 days of termination.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the platform at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the relevant courts.
